Terms of Service for Whiply

This is an unofficial English translation provided for convenience. In case of any discrepancy, the Swedish version shall prevail and is the legally binding version.

1. About these terms

These terms of service (the "Terms") apply when you use Whiply's website and mobile application (the "App") and the digital service Whiply provides (the "Service"). By creating an account or otherwise using the Service, you accept the Terms.

The Terms are supplemented by our Privacy Policy and any other rules or instructions shown in the app. If you do not accept the Terms, you must not use the Service.

2. Roles and definitions

  • • Whiply: provides the Service and enables mediation between users.
  • • Service Finder: user (car owner) who posts a need for car service.
  • • Service Provider: user (car expert) who responds to a listing and offers to perform car service.
  • • Job: the car service that the Service Finder and Service Provider agree upon via the Service.
  • • Stripe: third-party provider that supplies payment services and processes payments between users.

Whiply does not perform car service. Agreements for Jobs are made directly between the Service Finder and the Service Provider.

3. General description of the Service and registration

The Service is a digital marketplace for car service where private individuals can find and help each other. You can use the Service by posting listings, responding to listings, and performing listed Jobs. A single user may act as both a Service Finder and a Service Provider.

Only private individuals may register as users of the Service in the App. To register and enter into an agreement for the Service, you must be at least 18 years old and have the legal capacity to enter into agreements.

4. Account, eligibility and responsibility for use

  • • You must be at least 18 years old and have the legal capacity to enter into agreements.
  • • You are responsible for ensuring that information on your account is accurate and up to date.
  • • You may not share your account or let anyone else use it on your behalf.
  • • You are responsible for protecting your login credentials and must contact us if you suspect unauthorized access.
  • • You may only have one (1) account per person, unless Whiply expressly approves otherwise.

4A. ID verification

To perform service jobs as a Service Provider, you must complete ID verification via our third-party provider Stripe. This verification is carried out to increase safety and trust for all users of the Service.

Whiply reserves the right to request additional verification or documentation if needed. If you cannot or do not wish to complete ID verification, you may not act as a Service Provider, but you can still use the Service as a Service Finder.

5. Listings, communication and content

You are responsible for ensuring that information you provide in the Service is accurate, clear and not misleading. It is not permitted to post illegal, offensive, threatening or otherwise improper content.

Content in the Service primarily consists of listing text, location, vehicle/job details and messages between users.

Communication and agreements should primarily take place through Whiply's messaging feature. It is not permitted to attempt to bypass the Service's features, for example by requesting or suggesting payment outside the Service.

6. Jobs and the relationship between users

When the Service Finder and the Service Provider agree on a Job, they enter into an agreement with each other. They are responsible for agreeing on terms such as price, scope, location, time, materials/expenses and what is considered "completed".

  • • The Service Finder is responsible for accurately describing the need and providing reasonable conditions to perform the work.
  • • The Service Provider is responsible for only taking on jobs they are able and permitted to perform safely and professionally.
  • • The Service Provider is responsible for bringing the necessary tools and equipment to perform the service job.
  • • Both parties are responsible for complying with applicable laws, regulations and manufacturer specifications.

Whiply is not responsible for vehicle damage, personal injury, delays, faulty work, or other claims arising from the relationship between the Service Finder and the Service Provider.

6A. Insurance in case of damage

For Service Finders: We strongly recommend that you contact your insurance company before a service job to check whether your car insurance (comprehensive or similar) covers damage that may occur when another person performs service on your vehicle. Many car insurance policies may cover such damage.

Liability between the parties: In the event of damage or faults arising in connection with a Job, the Service Finder and the Service Provider are liable to each other according to the agreements made and applicable law. The Service Provider may be held liable for damage caused through negligence.

If damage occurs, the Service Finder may need to file a claim with their car insurance according to the insurance terms. Any disputes or compensation claims between the parties are handled outside the Whiply platform.

Whiply does not provide insurance for damage that may occur in connection with service jobs. Whiply also does not cover deductibles, repair costs or other expenses related to damage.

7. Payment and fees - Stripe

Payments within the Service are provided and processed by the third-party provider Stripe. Whiply does not process any payments and is not a payment service provider. Whiply does not handle card data and normally does not hold users' funds.

  • • To pay or receive payment, you may need to accept Stripe's terms and provide information to Stripe.
  • • Payment is made using the payment method you choose that is supported by Stripe.
  • • In the event of technical errors, chargebacks, or requirements for strong customer authentication, Stripe may require additional actions from you.
  • • Whiply charges an administration fee from the Service Provider's compensation for each completed Job. The fee is intended to cover Whiply's operating and development costs. The current platform fee is always shown in the App for Service Providers. Whiply reserves the right to change the fee level. Any changes will be communicated in the App and/or via email before they take effect.

8. Provisions for Service Providers (car experts)

As a Service Provider, you perform Jobs as a private individual. You may not use the Service to professionally perform jobs or conduct business operations through the App. If Whiply has reason to suspect that an account is being used professionally (e.g. abnormally high activity), Whiply may restrict or block access to the Service pending investigation.

  • • You may only take on jobs you have the competence, right and conditions to perform safely.
  • • You may not perform jobs that by law, regulation or industry rules require authorization/certification if you lack such authorization.
  • • You may not request payment outside the Service or request/claim higher compensation than what has been confirmed through the Service.
  • • You are responsible for your work environment, tools, materials, safety, and informing about risks.
  • • You are solely responsible for taxes, fees and other obligations linked to the compensation you receive.

9. Provisions for Service Finders (car owners)

  • • You must accurately describe the job (e.g. car model/year, symptoms, expected work, location and timeframe).
  • • You may not post illegal jobs or jobs requiring special authorization/certification if the person performing the work lacks such authorization.
  • • You may not pay the Service Provider outside the Service or pay more than what has been confirmed through the Service.
  • • If materials or additional expenses are needed, this must be clearly agreed between the parties before the purchase/expense occurs.

10. Cancellation, issues, disputes and refunds

The Service Finder and Service Provider are responsible for agreeing on cancellation terms and how any additional expenses should be handled. Whiply may offer features to report issues, but Whiply is normally not a party to disputes between users.

If you believe a Job was not carried out as agreed, you should first contact the other party through the App's messaging feature. For payment-related issues, Stripe's rules and processes also apply, and Stripe may affect how a payment can be reversed or disputed.

11. Prohibited use and safety

It is not permitted to use the Service for illegal jobs or jobs that involve unacceptable safety risks. Whiply may remove listings, stop communication, or suspend accounts that violate the Terms or pose a risk to users or third parties.

12. Taxes, fees and your own compliance

You are solely responsible for declaring and paying any taxes and fees related to compensation you pay or receive. If you perform Jobs frequently or at a larger scale, this may have tax or business-law consequences.

13. Whiply's liability and limitation of liability

The Service is provided "as is". Whiply strives for high availability but cannot guarantee that the Service will always be error-free or uninterrupted.

To the extent permitted by mandatory law, Whiply is not liable for indirect damages, lost profits, data loss or other consequential damages arising from your use of the Service.

Nothing in the Terms limits liability that cannot be limited under mandatory law (e.g. in the case of intent or gross negligence).

14. Suspension, termination and changes

Whiply may restrict or suspend your access to the Service if you violate the Terms, misuse the Service, create a risk to others, or if required to comply with law.

Whiply may update the Terms. For material changes, we will inform you in the app or via email. Continued use after the changes take effect means that you accept the updated Terms.

15. Personal data

Whiply processes personal data when you use the Service, for example for account management, communication between users, matching, and to enable payments via Stripe.

16. Governing law and disputes

The Terms shall be interpreted in accordance with Swedish law. Disputes between you and Whiply shall be resolved by Swedish general courts.
